Mediation method in Labor Law is increasing and becoming more efficient day by day and as a result, it gives the opportunity to face many different types of dispute as a mediator in Labor Law in Ankara. Title: Ankara Labor Law Mediator
Mediation is an alternative dispute resolution (ADR) method which is more common in countries with a developed law and justice system. It is the most effective way the parties can solve the dispute between them without appealing on court or with the guidance and suggestion of the court itself, with the help of an impartial third person. It can either be facilitating mediation which helps the parties to find their own solutions or evaluator mediation in which the mediator makes suggestions to a proper resolution to the dispute in some situations.
It is regulated in Code of Mediation in Civil Law Disputes Article 1: “The Civil Law disputes which are originated from the work and process that the parties can dispose on freely, including the foreign elemented ones are suitable for Mediation.” According to this, all the Civil Law disputes which are originated from the work and process that the parties can dispose on freely can be a subject for Mediation. In other words, Mediation can be possible for the subjects that that the parties can dispose on freely and that are not related to public order such as Labor Law, Commercial Law, private obligatios, Consumer Law, Rent Law etc.
All the Civil Law disputes which are originated from the work and process that the parties can dispose on freely are available for Mediation. In another saying, Mediation can be possible for the subjects that that the parties can dispose on freely and that are not related to public order such as Labor Law, Commercial Law, private obligatios, Consumer Law, Rent Law etc. It does not matter whether the dispute is a foreign elemented one. The main purpose of this regulation is that the disputes which concern the state, or in other words the public order, are not suitable for the parties to find a solution between themselves and there is a need for the state to involve. The Turkish Minister of Justice has recently been working on a more comprehensive regulation on Mediation which will also include the state institutions in a more active way.
Mediation is defined in Code of Mediation in Civil Law Disputes Article 2: “Mediation is an arbitrary dispute resolution method which takes part within the participation of an objective, independent and specialized third party who gathers the disputed parties with the aim of discussion and negotiation and starts the process of communication between them to make them understand each other and find their own solution as a result.”
